Seller Terms — Sukon Halal Marketplace
The rules for selling on Sukon, written to keep buyers safe and trade fair and halal.
1. Who we are and what Sukon does
The Sukon Halal Marketplace is run by INDO CHATS PRIVATE LIMITED, 168, G.T. Road, near Aloka Cinema, Shibpur, Howrah, West Bengal 711102, India (“Sukon”). Sukon is a marketplace: it lets checked sellers show their products, receive orders and get paid. The contract of sale is between the buyer and the seller. Sukon collects the price from the buyer on the seller’s behalf and pays it to the seller as set out in section 8, but does not buy, own or store the products. Sukon acts as a marketplace e-commerce entity and intermediary under the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020.
2. Who can sell
- Individuals over 18 and businesses that can lawfully trade in India, or that deliver lawfully to buyers in India from abroad.
- You must give true details: legal name, business address, customer-care phone, and GSTIN and FSSAI licence where the law requires them. We show your shop name, address, customer-care phone, GSTIN, FSSAI number and return policy to buyers, as rule 5 of the E-Commerce Rules requires.
- We check every application and may ask for documents. We may refuse or remove any seller at our discretion.
3. Halal and Islamic standards
- Everything you sell must be halal and fit for Muslim families. Food and cosmetics must carry halal certificate details from a recognised certifying body, and you must keep the certificate current.
- Attar and fragrances must be alcohol-free. Gelatine and animal-derived ingredients must be halal-certified.
- Do not call a product “halal-certified” unless you hold a valid certificate that covers that exact product. Sukon shows the “Halal certificate checked” badge only after our team has checked the issuer, the product it covers and its validity. A product being listed on Sukon does not by itself mean it is halal-certified.
- Islamic texts (Quran copies, hadith, duas) must be accurate, complete and printed with respect. Pirated or unauthorised editions are not allowed.
- Trade honestly: “O you who believe, do not consume one another’s wealth unjustly, but only through trade by mutual consent.” (Quran 4:29)
4. Products not allowed
- Alcohol, and perfumes or products that contain alcohol
- Pork, pork products and gelatine that is not halal-certified
- Meat, poultry and fresh food (Qurbani and Aqiqah are arranged through Sukon Services instead)
- Tobacco, vapes, intoxicants and drugs
- Medicines, supplements and anything sold with a claim to cure illness, including amulets sold as cures
- Gambling, lottery and betting items
- Counterfeit, copied or ‘first copy’ branded goods and pirated books
- Weapons, knives sold as weapons, and anything illegal in India
- Content that mocks any religion, or immodest or adult material
- Zamzam water, prasad of other faiths and religious items whose sale is restricted by law
Examples for each rule are in our Marketplace Policies. You must also follow the law of every place where you sell and deliver, including labelling and state rules.
5. Listings
- Use your own clear photos and an honest description. Show the total price including taxes, the MRP where printed under the Legal Metrology (Packaged Commodities) Rules, 2011, quantity, and country of origin.
- Give the manufacturer, packer or importer and their address; the brand where there is one; material or ingredients; sizes for clothing; publisher for books; and the BIS registration for mobile phones, laptops and toys, as Indian law requires.
- Confirm with every listing that the product is genuine and that you have the right to sell it. Do not sell replicas, “first copy” goods or books you do not have the right to sell.
- Every new or edited listing is reviewed before it appears. Approval does not mean Sukon guarantees the product.
- Do not post fake reviews, misleading discounts or claims you cannot prove.
6. Orders, payment and delivery
- Orders appear in your seller dashboard and are emailed to you. Confirm each order within 24 hours, ship it within the time you promise, and add the courier and tracking number in your dashboard.
- Buyers pay Sukon — today by cash on delivery collected by the courier, and online once Sukon’s payment gateway is live. Do not ask buyers to pay you directly for orders placed on Sukon. Include your tax invoice in the parcel.
- Deliver what was described, on time, safely packed. Use buyers’ personal details only to fulfil their order, and never for marketing without their consent.
7. Returns, refunds and complaints
- Follow the return and refund policy you show on your shop. You may not refuse to take back goods that are defective, deficient, spurious or not as described, or delivered late beyond the date promised.
- Answer buyer complaints within 48 hours and resolve them within one month, as rule 6 of the E-Commerce Rules requires. Sukon’s Grievance Officer can step in and may share your details with the buyer or authorities when the law requires.
8. Commission and payouts
Listing is free. Sukon charges a commission on the selling price (excluding the delivery charge) of each delivered order:
| Product category | Commission |
|---|---|
| Electronics — mobile phones | 5% up to ₹15,000 · 6% above ₹15,000 |
| Electronics — laptops | 6.5% |
| Dates & halal food (food & beverages) | 9% |
| Modest fashion (apparel & footwear) | 27% |
| Quran & Islamic books (books) | 15% |
| Prayer essentials and Islamic home décor (home products) | 15% |
| All other categories — attar & fragrances, gifts & Ramadan collections, halal personal care, kids & learning, Hajj & Umrah travel | 15% |
- Sukon pays you the order total (selling price plus delivery charge) 30 days after delivery, by bank transfer to the account you registered with us — including cash-on-delivery orders, once the courier has remitted the cash.
- Sukon deducts from each payout: the commission; GST at 18% on the commission (we issue you a tax invoice for it); GST tax collected at source of 1% under section 52 of the CGST Act, 2017; and income-tax deducted at source of 0.1% under section 194-O of the Income-tax Act, 1961, or the rates in force at the time. TCS and TDS are deposited against your GSTIN and PAN and appear in your returns.
- No commission is charged on orders cancelled before delivery, or returned and refunded before the payout date. If a buyer is refunded after you have been paid, we may recover the amount from your next payouts.
- We may change commission rates by telling you in writing at least 30 days before; new rates apply only to orders placed after that date.
9. Removal and suspension
We may hide a listing or suspend a seller who breaks these terms, receives repeated genuine complaints, or when the law or an authority requires it. Where we can, we will tell you why and give you a chance to fix the problem.
10. Liability
You are responsible for your products, your listings and your dealings with buyers, and you will compensate Sukon for losses caused by your breach of these terms or of the law. Sukon’s liability to sellers is limited to the extent the law allows.
11. Law and disputes
These terms are governed by the laws of India. Courts at Howrah and Kolkata, West Bengal have jurisdiction, without affecting a consumer’s rights under the Consumer Protection Act, 2019.
