Law Enforcement and Government Requests
How authorised agencies can request information about Sukon accounts — and how we protect our users while we comply with the law.
1. Who these guidelines are for
These guidelines are for police, courts, regulators and other government agencies who need information about a Sukon account or content. Sukon is operated by INDO CHATS PRIVATE LIMITED, a company registered in India, and responds to requests under Indian law. Members of the public should use the Grievance form or the Safety centre instead.
2. What information we may hold
Sukon collects very little. Depending on what a person used, we may hold: the email address used to sign in and when the account was created and last used; service requests and pledges (name, phone, city and the details entered); Dua Wall posts and welcome cards; partner and vendor registrations; and technical server logs kept for 30 days. We do not store messages from Sukon AI, location from the app, prayer or Quran activity, or any voice recordings. The full list, with how long each item is kept, is on our Data map. We cannot produce information we do not hold or have already deleted under our retention rules.
3. How to send a request
Send requests from an official government email address to legal@sukon.in, with a copy to grievance@sukon.in. Each request must:
- be on official letterhead, signed by an authorised officer, with name, rank, agency and contact details;
- state the legal provision it is issued under — for example section 94 of the Bharatiya Nagarik Suraksha Sanhita, 2023, sections 69, 69A or 69B of the Information Technology Act, 2000, rule 3(1)(j) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, or an order of a court;
- identify the account precisely (registered email address, request reference, or the URL of the content);
- describe the information needed and the period it covers, limited to what the investigation needs.
4. How we respond
We check every request is genuine and lawful before we act. For a valid request under rule 3(1)(j) of the IT Rules, 2021 we provide the information we hold within 72 hours. We may ask for clarification or narrow the request if it is unclear, too broad or not supported by law, and we may object to a request through proper legal channels. Content removal orders from a court or the appropriate government are acted on within 36 hours, as rule 3(1)(d) of the IT Rules, 2021 requires.
5. Emergencies
If there is an immediate risk of death or serious physical harm to a person, write to legal@sukon.in with “EMERGENCY” in the subject, describe the emergency and why the information will help prevent it, and follow up with formal legal process. We review emergency requests as a priority. In an emergency in India, always call 112 first.
6. Requests from outside India
Agencies outside India should use the Mutual Legal Assistance Treaty process or letters rogatory through the Government of India. We may respond directly to a foreign emergency request where Indian law permits.
7. Telling users
We tell users when their information is requested, so that they can seek legal help, unless the law or a court order prohibits it, or telling them would put someone at risk of harm or obstruct an investigation. We may tell the user later, once that reason no longer applies.
8. Preservation
We will preserve specific account information for up to 90 days on receipt of a valid preservation request, while the agency obtains formal legal process.
9. Child safety
Content that sexually exploits children is removed immediately and reported to the authorities, as the Protection of Children from Sexual Offences Act, 2012 requires. See the Safety centre.
